George Tumanishvili Juniors Law Office. Paper: Joint Community Property and Covenant of Marriage in Respect of the Procedure of Alienation of Public Land
The law concerning the public land for nonagricultural purpose prohibits alienation of the public land to alien natural and legal persons. However, there are many ways for an alien natural person or a legal person of a foreign country to purchase the public land. The paper regards two cases: 1. Where a citizen of a foreign country is the founder or one of the founders of a profit legal person; Where a citizen of Georgia is lawfully married to a citizen of a foreign country. Below is given the ways and mechanisms which provide an alien with the facility to purchase the public land in the concreted above-mentioned cases. Though the applicable law prohibits alienation of the public law to citizens and legal persons of foreign countries, this legal provision is ineffective as the Georgian law is lacking the definition of “nationality” of a legal person and the list of documents to be provided by bidders for the land auctions is incomplete.
